Terms and conditions

1. Key Times and Dates

This contest (the “Contest”) is organised and sponsored by Jot Technology Solutions (“Jot Technology”), and begins on May 12, 2023 at 12:00 a.m. Eastern Time (“ET”) and ends on June 15, 2023 at 11:59:59 p.m. ET (“Closing Time”).

2. Eligibility

The Contest is available to everyone resident in Canada who is eighteen years or older, except for residents of the Province of Quebec and except for Jot employees, their families, agents, and anyone else directly involved in the administration of the prize draw.

By participating in the Contest, you are signifying your agreement that you have read and agree to be legally bound by these Terms and Conditions.

3. How to enter

Entries generated or submitted after the Closing Time will not be accepted.

Between May 12, 2023 and the Closing Time:

Each individual who before the Closing Time downloads the Jot™ App through the http://onelink.to/wyhr59 link at the Apple Store or Google Play and initiates using it will be automatically entered;

Each Jot™ App User will get an entry for every referral that they make using their unique referral link that results in that referral downloading the Jot™ App before the Closing Time; and

Every Jot™ App User will get two (2) entries into the Contest if they upgrade their account to a JotPro™ subscription before the Closing Time.

A tutorial on how to make a referral is provided at www.jottech.app/tutorial-referrals.

Jot will track the unique referral link attribution back to the referring Jot™ App User and add an entry for the referring user.

For the Jot™ App User who upgrades to a JotPro™ subscription Jot will track the upgrade and payment in the user’s app console and Jot will add two (2) entries for that user.

No purchase is required to participate in the Contest. If you are not otherwise entered in the Contest as provided for above you may apply once for one (1) entry by completing the form found at www.jottech.app/collison and submitting it to hi@jottech.app prior to Closing Time. Entrants will receive a notification of their entry by email .

Only one entry per individual is permitted, unless the above conditions for extra entries are met.

4. Entry and Entrant Verification

All entries are subject to verification at any time and for any reason. Jot Technology reserves the right in its sole and absolute discretion to require proof of identity and eligibility (in a form acceptable to it) for the purpose of verifying an individual’s eligibility to participate in the Contest, for the purpose of confirming legitimacy of an entry or other information entered (or purportedly entered) and for any other purpose of administering the Contest in accordance with Jot Technology’s interpretation of these Terms and Conditions and the applicable law.

Failure to provide the proof to the satisfaction of Jot Technology may result in the disqualification of the individual in the sole and absolute discretion of Jot Technology.

Jot Technology takes no responsibility for entries that are incorrect, lost, or incomplete for any reason.

If a participant violates these Terms and Conditions, Jot Technology reserves the right to reject the entry and / or awarding the prize.

5. Prizes and Draw Process

There are a total of four (4) admission tickets to the Collision Technology Conference being held on June 26 – 29 at the Enercare Centre in Toronto, Ontario, as the prizes of this Contest.

Each ticket has an estimated value of $1,000 CAD.

The odds of winning a Prize depend on the number of eligible Entries submitted and received in accordance with these Terms and Conditions.

Each winner will be chosen by random draw conducted by an automated electronic raffle generator, promptly after the Closing Time.

An individual can only win once. If they are chosen again Jot Technology will select another eligible winner in accordance with the process described above.

6. Winner Confirmation Process and Publicity

Each initial eligible winner will be notified by email, via Jot™ App (in-chat group created for this Contest) or the email provided on the entry form, by 5:00 p.m. on June 16, 2023 . If a winner does not respond back to Jot Technology and complete the verification and skill testing requirements within 48 hours of being notified, then the winner’s prize will be forfeited and Jot Technology will be entitled to select another eligible winner in accordance with the process described above.

NO ONE IS A WINNER UNLESS AND UNTIL JOT TECHNOLOGY OFFICIALLY CONFIRMS HIM/HER AS A WINNER IN ACCORDANCE WITH THESE TERMS AND CONDITIONS, EVEN IF SUCH PERSON IS ANNOUNCED AS A WINNER OR AN ELIGIBLE WINNER. BEFORE BEING DECLARED AS A CONFIRMED PRIZE WINNER.

Each eligible winner will be required to correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of Jot Technology, be administered online, by email or other electronic means, by telephone, or in Jot Technology’s form of declaration and release). Additional verification (see 4 above) may also be required.

Each confirmed winner agrees to the publication, reproduction and/or other use of their first and last name, and, at Jot Technology’s option provided it quotes them accurately, any statements made by them about the Contest, without further notice or compensation, in the announcement of winners and in any publicity carried out by or on behalf of Jot Technology in any manner or medium whatsoever, including print, broadcast, on websites and social media.

7. General Conditions

By participating in the Contest, you: (i) confirm compliance with these Terms and Conditions; (ii) release Jot Technology and its officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties” ) from any and all liability in connection with this Contest, your participation in it and/or the awarding and use/misuse of the applicable awarded prize or any portion thereof.

The sole determinant of time for the purposes of this Contest will be the official time-keeping devices(s) used by Jot Technology.

Jot Technology and the Released Parties makes no representation nor offers any warranty, express or implied, as to the quality or fitness of any prize awarded in connection with the Contest. To the fullest extent permitted by applicable law, each confirmed winner understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from Jot Technology or the Released Parties should his/her prize fail to be fit for its purpose or is in any way unsatisfactory. For greater certainty and the avoidance of any doubt, by accepting a prize each confirmed winner agrees to waive all recourse against the Jot Technology and its Released Parties if the prize or a component thereof does not prove satisfactory, either in whole or in part.

Each Prize must be accepted as awarded, no substitute is provided and the prize is not exchangeable, transferable or convertible. However, if it becomes necessary due to reasons beyond Jot Technology’s control, it retains the right to substitute a prize of equal or greater retail value.

The decisions of Jot Technology with respect to all aspects of this Contest are final and binding on all entrants without right of appeal. ANYONE DEEMED BY JOT TECHNOLOGY TO BE IN VIOLATION OF JOT TECHNOLOGY’s INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE TERMS AND CONDITIONS FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF JOT TECHNOLOGY AT ANY TIME.

Without limiting the foregoing, Jot Technology reserves the right to refuse an entry from any person whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter. In its sole and absolute determination, Jot Technology may disqualify any person who acts in any manner to threaten or abuse or harass any person and to void all such person’s entries.

Jot Technology and the Released Parties will not be liable for (i) any technical malfunction or other problems of any similar nature whatsoever and howsoever caused; (ii) the failure of any information or materials whatsoever to be received, captured, recorded or function properly for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iii) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; (iv) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; and/or (v) any combination of the above.

In no event whatsoever will Jot Technology or the Released Parties be liable for more than the number, type and value of prizes as stated in these Terms and Conditions.

The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms and Conditions shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.

To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions or the rights and obligations of participants and/or Jot Technology in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. The parties hereby consent to exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Terms and Conditions or relating to this Contest.

Jot Technology reserves the right to deem this Contest invalid, suspend, or modify it if in its sole opinion this is necessary.
